(“the Company”)

This Boat Storage Rental Agreement (“Agreement”) is entered into by and between:

1. Storage Space & Type

1.1 The Company agrees to provide the Client with non-exclusive use of a designated storage bay/space for the Client’s boat at Helu Park, Protea Rd, Klapmuts, 7625.

1.2 The Client shall select one of the following storage options:

• Indoor Storage (fully enclosed, maximum protection)
• Under Cover Storage (roofed but open sides)
• Outdoor Storage (open-air, no cover)

1.3 Boat details:

• Make/Model
• Registration/Identification Number
• Length
• Width/Beam

2. Term & Cancellation

2.1 This Agreement commences on the date selected below and continues on a month-to-month basis.

2.2 Either party may terminate this Agreement by providing one (1) calendar month’s written notice.

3. Rental Fee & Payment

3.1 The monthly rental fee depends on the storage option chosen:

• Indoor: R 64.- per m2 / month
• Under Cover: R 51.- per m2 / month
• Outdoor: R 32.- per m2/ month

3.2 Fees are payable in advance on or before the 2nd day of each month.

3.3 Late payments may attract interest at 2% per month until settled.

3.4 The Company may suspend access or terminate this Agreement if fees remain unpaid for more than 30 days.

3.5 Pricing is inclusive of VAT

4. Optional Extra Services

The Client may request the following services (charged per use, unless otherwise agreed):

• Post-Delivery Clean (R 850.-)
• Pre-Collection Clean (R 850.-)
• Battery Charging Service (R250.-)
• Boat Pick-Up (price on request)
• Boat Drop-Off (price on request)

Charges for extra services will be invoiced separately or added to the monthly account.

5. Client’s Responsibilities

5.1 The Client shall ensure that the boat is:

• Properly secured, maintained, and seaworthy.
• Free of fuel leaks, oil leaks, or hazardous substances.
• Compliant with legal licensing and registration requirements.

5.2 The Client may not:

• Use the storage space for residential or business purposes.
• Conduct major repairs, painting, or refuelling on site without the Company’s written consent.
• Store loose fuel, gas bottles, or hazardous substances except in installed tanks.

6. Liability Disclaimer

6.1 The Client stores the boat at their sole risk.

6.2 To the fullest extent permitted under South African law, the Company shall not be liable for:

• Theft, vandalism, fire, flood, storm, or other natural disasters.
• Damage caused by pests, rodents, insects, or wildlife.
• Loss or damage caused by third parties, other tenants, or contractors.
• Any injury or death sustained by the Client or their visitors on the premises.

6.3 The Client is responsible for maintaining adequate insurance for their boat, trailer, and accessories.

7. Indemnity

The Client indemnifies the Company, its directors, employees, and agents against any claims, damages, or legal costs arising from:

• The Client’s use of the facility.
• Any breach of this Agreement.
• Damage caused by the Client’s boat to other boats, persons, or property.

8. Access & Security

8.1 Access to the facility shall be during 08.00 am to 17.00 pm or as otherwise agreed.

8.2 The Company may install security measures (gates, CCTV, fencing), but does not guarantee absolute security.

9. Governing Law

This Agreement is governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of Western Cape.

10. Entire Agreement

This Agreement constitutes the entire agreement between the parties and may only be amended in writing and signed by both parties.
